              DISCUSSION

A.              Discussion of regulations for medical marijuana dispensaries

Don Conn stated the Legislature met last week in Special Session and made changes. The focus for the workshop will be regarding the role of local government with Medical Marijuana Dispensaries. Special Session-Senate Bill 8A has made changes to number of dispensaries per population, expands the medical conditions for use, no waiting period for patients, a 70 day supply is allowed to be prescribed and a 30 week follow up visit. Senate Bill 8A states there is an exception if someone is properly prescribed and they are using or in possession of medical marijuana, they are exempt from the controlled substances laws dealing with use, possession, manufacture and delivery. Treatment Center options under new law are more limited but cannot be more restrictive than pharmacies. Local regulation after Special Session would allow the Board to ban medical marijuana treatment facilities by Ordinance. 

Mr. Conn requested direction from the Board on an Ordinance deciding whether to allow dispensaries in DeSoto County. He also received clarification that banning dispensaries would not prohibit an approved grower from being located in the County. If they are not banned, local regulations cannot conflict with state rules but those rules have not been adopted. The Board agreed they would like to review the Department of Health rules and regulations before deciding whether to allow dispensaries in the County.

There being no further business, Chairman Langford adjourned the meeting at 12:10pm.
