RESOLUTION NO. 2017 - ___

 

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF DESOTO COUNTY, FLORIDA, DECLARING A PUBLIC HEARING ON DECEMBER 12TH, 2017 FOR THE PURPOSE OF HEARING A VACATION OF RIGHTS-OF-WAY APPLICATION (VR 2016-01) FILED ON BEHALF OF IGLESIA CRISTIANA PACTO DE FE, INC. TO CLOSE AND ABANDON AN ALLEY RIGHT-OF-WAY AND A PORTION OF A ROAD RIGHT-OF-WAY AS DESCRIBED HEREIN; AND PROVIDING FOR AN EFFECTIVE DATE.

 

WHEREAS, DeSoto County Board of County Commissioners of DeSoto County, Florida, is setting a public hearing to be held pursuant to Chapter 336, Florida Statutes, in consideration of closing and abandoning and alley and a portion of a road; and

 

WHEREAS, the notice of public hearing was set in compliance with DeSoto County Land Development Regulations Section 14203 F; and

 

WHEREAS, the Board finds adoption of this resolution is in the best interest of the residents of DeSoto County, Florida.

 

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESOTO COUNTY, FLORIDA, AS FOLLOWS:

 

              Section 1.  The foregoing “WHEREAS” clauses are ratified and confirmed as being true and correct and are hereby incorporated by reference as part of this Resolution.

 

              Section 2.   A public hearing to consider closure and abandonment of an alley and a portion of a road described in “Exhibit A” and sketched in Exhibit “B” will be held on December 12th, 2017, at 6:30 pm, or as soon thereafter as practical, in the Commission Room of the DeSoto County Administration Building.

 

              Section  3.  In the event that any portion of this resolution is found in conflict with other provisions of the Land Development Regulations or is, for any reason, held invalid or unconstitutional by any court or competent jurisdiction, such holding shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this resolution.

 

              Section  4.   This Resolution shall take effect immediately upon its adoption.

 

                            PASSED AND ADOPTED this 14th day of November, 2017.

Exhibit “A”

 

The portion of the public alley and road rights-of-way to be closed and abandoned are legally described as follows:

 

That certain 10.00 foot wide alley lying within block 23, King and Baker subdivision, as recorded in Plat Book 1, Page 105 of the public records of DeSoto County, Florida;

 

Together with:

 

That 50.00 foot wide portion of First Street lying East of Block 23 and lying West of Block 24, and lying South of Olive Street and North of Hargrave Street, Less that portion of the East half (1/2) of First Street lying West of Lots 7 and 8, Block 24, and lying South of the Westerly projection of the North line of Lot 7, Block 24, King and Baker Subdivision, as recorded in Plat Book 1, Page 105 of the public records of DeSoto County, Florida.
